SC seeks response of EC on plea against prosecution of elector for complaining against EVMs, VVPATs


Ahya challenged Rule 49MA of the Conduct of Election Rules on the ground that when a citizen suspects an error or "deviant behaviour" in any EVM/VVPAT, he can report the same to the presiding officer at the booth. On payment of Rs 2, he can challenge his earlier vote by giving a written declaration and going for a test vote which must be given in the presence of the candidate or his polling agent. If the machine or VVPAT does not report any error, the voter shall be booked under Section 177 of Indian Penal Code for furnishing false information. This provision entails jail up to two years or a fine of Rs 10,000. Further, the test vote to be made in presence of candidate/polling agent defeats the secrecy of ballot.
