Musalia Mudavadi has termed the decision to outlaw IEBC demos "an overthrow of the constitution and declaration of martial law". Martial law refers to the control and government by the top-most military officer in cases of civil unrest. He said there is no law that empowers anyone or any institution to criminalise the constitution, and that martial law is only invoked as a last resort to counter popular uprisings. Mudavadi reminded Jubilee that only courts uphold or limit the enjoyment of fundamental rights and freedoms. Chapter Four covers matters including rights and fundamental freedoms, when a state of emergency can be declared.
