In this case, there was no showing that Alanano acted with manifest partiality, evident bad faith, or gross inexcusable negligence in collecting the transportation allowance. 79 was released, which prohibited the giving of transportation allowance to official who were assigned a government vehicle, Alanano’s co-accused stopped releasing the former mayor’s transportation allowance. “It can be shown that the government suffered no injury as accused Alanano has reimbursed the disallowed allowance by not collecting his transportation allowance for the succeeding months despite his entitlement to said allowance,” the decision stated.
