Appeal court dismisses Onnoghen’s request to stop CCT trial

Kamarudeen Ogundele, AbujaThe Court of Appeal, Abuja Division, on Wednesday dismissed an application for a stay of proceedings filed by the suspended Chief Justice of Justice, Walter Onnoghen, against the Code of Conduct Tribunal. The court said the charges filed against Onnoghen were criminal in nature, therefore proceedings before the CCT could not be stopped. In the unanimous ruling, Justice Aboki said, “Affidavits must be examined and juxtapose them with facts to establish whether the application is justifiable. “I’m of the view that the application for stay of proceedings before the court ought to be refused. He stated that the tribunal was bound to first determine if it had jurisdiction before any application could be determined.
