He also failed to file any income tax returns since 2005, GST since 2007 and PAYE returns from 2010. "Clearly you have been captured by a gambling addiction," noted Judge Sharyn Otene when Barbalich came before her for sentencing in the Hamilton District Court on Monday on three representative charges of tax evasion. "This man had a problem with gambling," Senar said. This brought his jail term down to 24 months, which is within the range where home detention can be applied.
