The Supreme Court halted implementation of the plan pending resolution of a state lawsuit in federal court in the District of Columbia. During oral arguments over the Trump immigration plan, Judge Robart asked Ferguson if the Constitution and the Equal Protection Clause of the 14th Amendment apply to foreign visa holders who haven't set foot on U.S. soil.
