The CKRC draft was based on the assumption not only that diversity was a positive factor but that it could be reconciled with national unity. But few of them discuss the approach of the constitution to diversity and unity. A great deal of the constitution is concerned with balancing diversity with unity, as is presaged in the preamble: “We, the people of Kenya ...proud of our ethnic, cultural and religious diversity, and determined to live in peace and unity as one indivisible sovereign nation”. My purpose now is not to go over the debate but to show how the new constitution attempts to resolve the tension. I believed that already Kenya’s politicians had manipulated ethnicity to their political ends, with great harm to the country.
