A disagreement over those clauses saw CFS sue Catley in the Wellington District Court, then appeal that decision to the High Court. Scott was already committed to flying three other aircraft, but he was the only other person in Australasia qualified to fly Catley's aircraft, court documents show. Judge Hastings also found that a "reasonable commercial person" would have interpreted Catley's email as a notice to remedy the contract breach. She said a contractual notice must make its intentions or consequences clear, and Catley's email was "deficient".
