The commission said the temporary order, granted by supreme court judge Njoki Ndung'u, violated the constitution. Ndung'u gave orders stopping Rawal's retirement after a 7-bench judge declared that the latter should retire at 70 years. JSC is protesting an order extending Deputy Chief Justice Kalpana Rawal's retirement. JSC added that the judgement of Rawal's appeal being challenged by Rawal was not attached to the documents before Ndung'u. But JSC supports Mutunga's actions saying the constitution gives him powers to give general direction to entire judiciary, which includes supreme court judges.
