Insurance firm told to pay damages


The State Consumer Disputes Redressal Commission has directed National Insurance Company Ltd. to pay a compensation of ₹2 lakh to a person for repudiating his claims made under an overseas mediclaim policy. The claim was repudiated by the insurance company saying that the medical condition and diseases suffered by him was on account of the pre-existing disease of aneurysm. Nobody could be supposed to have knowledge of pre-existing disease of aneurysm unless the symptoms occur with consequences of bodily ailment, it said. The commission directed the insurance company to reprocess the claim with reference to the medical records produced and sanction the amount due in terms of the policy. The insurance company was also directed to pay a cost of ₹50,000 as well to the complainant.
