Folau has grounds for legal claim against religious discrimination: experts


Wallabies star Israel Folau will have a legal defence on the grounds of alleged religious discrimination under national employment law if Rugby Australia terminates his contract. The controversy erupted after he posted a warning on social media saying that "Hell waits" drunks, homosexuals, adulterers, liars, fornicators, thieves, atheists and idolators unless they repent. However, an employee from any state can make a claim against dismissal under the Commonwealth Fair Work Act 2009 alleging discrimination under section 772 on the grounds of religion. Rugby Australia said Folau was an "employee" of Rugby Australia and the NSW Waratahs. Rugby Australia said Folau could not share material that "condemns, vilifies or discriminates against people on the basis of their sexuality".
