Farming contractors take machinery supplier to court over alleged faulty balers


Two Southland farming contractors are taking a machinery supplier to court, alleging the equipment they bought was faulty. A judgement issued by Associate Judge PJ Andrew, on June 9, says Wyndham Contracting Limited and Lintley Contracting Limited bought Göweil balers from Webbline Agriculture Ltd, a Waikato-based company with a branch in Gore. The contractors allege that the balers are faulty, saying amongst other things, that there are “severe issues with the chain breaking and tensioners failing.”They are suing Webbline Agriculture Ltd for misrepresentation, breach of implied condition as to merchantable quality and breach of implied condition that the goods were reasonably fit for purpose. The companies say this was a result of counsel error and the statement of claim should have been filed in the Invercargill registry. At a hearing on June 1 they sought an order to have the proceedings transferred to the Invercargill registry and for the trial to be held there.
