When the National Super Alliance filed a petition at the Supreme Court challenging the election of President Uhuru Kenyatta on August 8, which court quashed the result, the verdict was that the electoral commission had failed. PETITIONSWhen many other petitions are questioning the legitimacy of Thursday’s election, the message is that the Independent Electoral and Boundaries Commission is perceived to have fallen short of the threshold for conducting proper elections. Seeking legal recourse is a constitutional right but does not provide the cure – it only postpones the problem.
