Michael Theriault, the Toronto officer convicted of an assault that left Whitby man Dafonte Miller seriously injured. “These are offences that shatter a community’s trust in the system,” Di Luca wrote in his sentencing decision in November. Reid argued that Di Luca had improperly divided the incident into separate stages when instead the “whole chain of events” should have been considered. Di Luca found that was false, and that parts of Miller’s account were “concocted” to hide that he was breaking into cars. Crown lawyers have asked for a new trial only if Theriault’s assault conviction is overturned.
