Check your brokerage contract before making a private deal: Ask Joe

Before listing your home, you would have signed a listing agreement with the brokerage that employs your salesperson. That agreement is a binding contract to work with the brokerage for a set amount of time. During the time period that the contract is still in effect, you need to tread very carefully in conducting any private arrangements with would-be buyers. It’s very likely that if you engage in a private sale while the listing agreement is in effect, you will owe commission to your brokerage. With that in mind, you should check the terms of the contract before taking any further action.
