Our Legal CorrespondentNew Delhi: A person appearing before a court following a summons or arrest warrant has no inherent right to bail, the Supreme Court has ruled. The apex court said that Section 88 of the Criminal Procedure Code grants a court the "discretionary" power to release someone brought before it on a summons or arrest warrant, and the accused cannot claim he must be released as a matter of right. The court noted that Jain had for a long time evaded the CBI court despite the issuance of a non-bailable warrant, a declaration as a proclaimed offender, and attachment of his property. Jain had earlier unsuccessfully challenged the issuance of the summons and the arrest warrant in the high court and the apex court, following which he appeared in the CBI court which refused to grant him bail. In this view of the matter, he was not entitled to the benefit of Section 88," the apex court said.
