A landlord wrongfully evicted tenants from his property after they made complaints about black mould and birds nesting inside. Tenants Kristy and Kyle Rosby were issued a 42-day notice to leave the property on Kingsway Avenue, Sandringham in August last year when landlord Jian Wen claimed he intended to move in. However according to the tenants the eviction notice came a few days after they raised the issue of long overdue repairs and maintenance. After leaving the residence in September, the tenants discovered three weeks later the property was advertised on Trade Me for rent. The tribunal ruled Wen issued an improper 42-day notice and that a 90-day notice should have been served.
