Sgt Muldrew told McCallum he needed to undergo an evidential breath test, which he refused to do, instead becoming verbally aggressive towards the officer. McCallum refused to go with Sgt Muldrew to the Oamaru police station and back-up officers were called. During this altercation, police said McCallum verbally abused and grabbed Sgt Muldrew and struck another officer. That officer, Sergeant Tony Woodbridge, told the court he struck McCallum in the head with a closed fist after he grabbed Sgt Muldrew and made a threat against Sgt Muldrew. "He threatened or stated he was going to put Sgt Muldrew in a hole."
