In the pre-Revolutionary era, British courts in London secretly issued general warrants to British government agents in America. FISA established a secret court and permitted it to issue warrants authorizing spying on agents of foreign governments when physically present in the United States. We don’t know whether the authors of this scheme really wanted federal spies to be able to spy on anyone at will, but that is where we are today. The chickens have come home to roost. Andrew P.
