Kenya, Uganda and South Africa have previously been accused of failing to arrest President Bashir. The Peace and Security Council of the African Union has recommended to the African States Party to the Rome Statute to ensure there is no provision that mandates UN peacekeeping missions to enforce ICC arrest warrants in Africa. South Africa has said it might leave the ICC after a row over the court’s attempt to have the President arrested there.The ICC has no power to enforce its own arrest warrants and relies on its members’s compliance. Through a statement, the PSC says this will affect the neutrality and impartiality of UN mandated Peacekeeping missions and undermine the ability of member states of the UN to contribute troops to peacekeeping operations. Sudan President Omar al-Bashir has been wanted since 2009 by the ICCon charges of crimes against humanity, war crimes and genocide in Sudan’s Darfur region.
