The former Managing Director explained that the buses and spare parts were supplied to MMTL under a state-to-state arrangement between the governments of Ghana and Belgium, which exempted them from taxes. "At the initial stage, MMTL did not receive full tax exemptions from the government, slowing the process, and later, additional costs imposed by the shipping line further prolonged the release of the buses and spare parts," Adu Boahen said. Adu Boahen also claimed that by the time they succeeded in negotiating tax exemptions with the Ghana Revenue Authority (GRA) and the Ministry of Finance, the issue of shipping line costs also arose. "By the time the MMTL was able to get the Ministry of Finance to issue a waiver for the imports, the shipping line costs had also become an issue, with estimated charges of over GH¢300,000."

Justice Kocuvie-Tay subsequently criticised the OSP's handling of the matter, stressing that accused persons and their lawyers must not be detained or investigated over issues pending before the court. As a result, the judge varied the bail conditions of the accused persons, reducing their reporting schedule at the OSP from weekly to once a month, effective March 2026. The judge then asked the Deputy Attorney General, who was also in court, to look into the allegations against the OSP.
