In reality this is clearly a more democratic interpretation of the Constitution than by Judicial ruling by life time appointees. The second exampleunlike the first, involves a part of the Constitution on which the Supreme Court has already ruled. It is also worth remembering that there is not a word in the Constitution that provides explicitly for judicial review, and the Constitution certainly does not mandate unqualified judicial supremacy.
