A windfarm operator is to appeal a widely consequential ruling requiring it to pay more than €300,000 damages for noise nuisance caused to its neighbours. In a judgment published this week, the judge agreed to defer an order requiring Donnybrook-based operator Meenacloghspar (Wind) Limited to pay out damages to the four plaintiffs in two separate cases. The pause to the payment order is to last until the determination of Meenacloghspar’s appeal of her decisions in the actions. In its intended appeal, Meenacloghspar will allege the High Court erred legally and factually in a range of its findings. She noted the company is prepared to pay interest on the damages to the four plaintiffs in the event its appeal fails.
