This is no doubt why it went to the Supreme Court, and the Attorney-General sent an advocate to take part in the argument. In my view, this decision by the Supreme Court is wrong and worrying, and has the effect of reducing the effectiveness of the CAJ. The Supreme Court decision is worrying because of its policy consequences. The other option would be to wait for a similar case to reach the Supreme Court so that the Supreme Court can reverse its decision. It could have gone to the Employment and Labour Relations Court, as the Supreme Court said.
