Michael Theriault and his younger brother Christian Theriault are jointly charged with aggravated assault and separately charged with attempting to obstruct justice. They have pleaded not guilty in a judge-alone trial before Ontario Superior Court Justice Joseph Di Luca. “He used that pole as a weapon and assaulted both Christian Theriault and Michael Theriault and, in the course of them defending themselves, Dafonte Miller suffered the horrific injury,” Lacy said. He alleges he was kicked, punched and then hit in the head with a pipe by Michael Theriault, and put in a headlock by Christian Theriault.
