A family was appealing in a dispute over what could be included in law as “special educational provision”. As interesting as the causes of Electromagnetic Hypersensitivity may be, the case is about whether a solution to the child’s difficulties can be counted as special educational provision. The legal implications of a recent Upper Tribunal judgement on what is “special educational provision”. The only remaining question was whether the provision sought – mainly a Wi-Fi free environment – amounted to “special educational provision”.
