Today President Trump signed the Energy Independence Executive Order that sets in motion measures to reverse several major Obama Administration climate rules. Today’s executive action reportedly orders the Department of Justice to ask the DC Circuit Court to freeze the legal challenge currently pending against the rule. The executive order itself does not abrogate the CPP, but directs EPA to begin the process of doing so. The EPA will almost certainly get sued as this unfolds, but the specific legal challenges that ensue will be more clearly defined once federal agencies act based on the directives set forth in today’s executive order. In addition to protracted legal wrangling, increased State-Federal animosity is another potential outcome from today’s executive action.
