Triple talaq: SC to determine whether practice is fundamental to Islam


Commencing a historic hearing on a clutch of petitions challenging the constitutional validity of the practice of triple talaq and 'nikah halala' among Muslims, the apex court said it would first determine whether the practice is fundamental to Islam. "There are 2-3 things in our minds and the first is whether this (triple talaq) is fundamental to the religion (Islam). The triple talaq is not integral to Islam and hence cannot be protected under Article 25 (fundamental right to practice religion), he maintained. Section 2 of the Muslim Personal Law (Shariat) Application Act, 1937 does not talk about triple talaq. However, Grover said, "talaq in section 2 of the Act has to be interpreted to exclude triple talaq".
