Can the U.S. government issue a legal warrant to require a U.S. company to retrieve overseas digital communications from its foreign customers? The controversy, however, was that the customer in question was Irish, who lived in Ireland and his digital communications resided on a data server in Ireland. In retaliation, would Ireland and other foreign countries now have a free hand to demand privacy data from U.S.-based servers housing digital communications from U.S. citizens? Would foreign countries act against U.S. private firms by boycotting their services and products, as well as prohibiting U.S. firms from participating in foreign government contracts? The CLOUD Act would provide the necessary multilateral framework for countries to request communications and other electronic data from servers and computers located within other countries.
