The National Crime Records Bureau (NCRB) data indicates that the incidents of child rape have increased by 82 per cent in 2016 vis a vis 2015. In 2016, of the 64,138 child rape cases that came up before the courts under the POCSO Act, 1,869 cases, i.e. Should the psychological condition of those guilty of child rape not be taken into account before doling out a harsh punishment? The study further showed that death penalty is disproportionately imposed on vulnerable persons along the axis of economic and social parameters.
