In April 2015, Christopher went to court, seeking an order for a paternity test, and later for custody of the child. Jessica, the mother, asked the appeal court to dismiss Christopher’s claim on two grounds. First, the child of a marriage is presumed to be “legitimate” as a “product of the marriage” under New York law. So by the time he filed for paternity, he had already “acquiesced” in the establishment of a parent-child relationship between the girl and Nichole, the appeal court found. “It would represent an injustice to the child and her family to permit him to much later change his mind and assert parental rights,” the appeal court found.
