He said a trial should be held in which damages could be sought if Sky TV could prove its business activities were affected by Fairfax's publishing of Sky Olympic Games material. Sky TV sought the judgment arguing Fairfax, publisher of Stuff, was "effectively stealing" its material under the guise of fair use. He argued there was no evidence that either Sky TV or the International Olympic Committee (IOC) was an exclusive licensee, which Sky disputed.
