Sky TV lawyer Julian Miles QC claimed Fairfax exploited Sky footage for its own commercial gain. Lawyers for Fairfax say there is "nothing outrageous" about its use of Sky's Olympics footage, while Sky TV argues that Fairfax was "effectively stealing" Sky's material under the guise of fair use. Sky TV filed an application for an interim injunction over Fairfax's use of Olympic Games videos on Fairfax-owned website Stuff.
