Gumbo dismissed the ruling saying that he was the "people's governor" adding that he will consult with his lawyers on whether to lodge an appeal or not. Justice Maina ruled that Midiwo did not provide sufficient evidence to prove that the August 8, 2017 election was marred with irregularities. In Kisumu, Justice David Majanja dismissed a petition challenging the election of Edward Kaunya as Teso North MP. Ndungu said the degree of prove in any election petition should be above balance of probability.
