The data protection commissioner (DPC) had ruled that the disclosure on Prime Time in May 2013 was a breach of the Data Protection Act. The circuit civil court upheld this decision and dismissed Mr Shatter’s first appeal, before the High Court found in his favour. When discussing the penalty points controversy on air with Mr Wallace, an independent TD, Mr Shatter said that gardaí were entitled to use discretion when awarding points.
