Q Our tenants are behind with their rent and we want to give them a section 8 notice to end the tenancy. Can we do it by email or do we have to send them a letter? A The method of giving statutory notices varies from one piece of legislation to another. Under the Housing Act 1988, a landlord may not issue possession proceedings to end an assured shorthold tenancy early unless it has “served” the tenant with a notice of proceedings under section 8 of the act. The form of notice is prescribed by the Assured Tenancies and Agricultural Occupancies (Forms) (England) Regulations 2015, which require the notice to be signed by the landlord or its agent.
