Share TweetBy Czarina Nicole OngThe Sandiganbayan Sixth Division has denied the motion for leave to file demurrer to evidence of former Bogo, Cebu Mayor Celestino Martinez III, seeking to challenge the prosecution’s evidence in his graft charge involving the fertilizer fund scam. Filing a demurrer to evidence is an act contesting that the evidence offered in the case as insufficient. In his motion, Martinez said that he did not act with manifest partiality, nor did he give unwarranted benefits to Sikap Yaman. However, doing so means he is waiving his right to present evidence and the case is submitted for judgment.
