However, Pichay’s demurrer was denied on October 17 because the anti-graft court found that the evidence presented by the prosecution is sufficient enough for trial. In a resolution promulgated on November 29, the Sandiganbayan denied his MR since Pichay presented no compelling argument for it to reconsider its earlier ruling. The Sandiganbayan earlier granted him leave to file demurrer to the breach of conduct charge but denied the same leave for his graft charge.
