In the case Justice Rawal and Justice Philip Tunoi challenge a decision of seven Court of Appeal judges sending them home at 70. Deputy Chief Justice Kalpana Rawal will tomorrow know whether she will rise to the apex of her career serving the nation as Chief Justice in an acting capacity or head home. In the event the court holds that it does not have jurisdiction, it would mean Rawal will enjoy temporary orders suspending her retirement, which in turn gives her chances of acting as CJ. The five are Chief Justice Willy Mutunga, justices Mohammed Ibrahim, Jacktone Ojwang, Smokin Wanjala and Njoki Ndung’u. This action by Mutunga was met with opposition from the two judges, who said their boss did not have the powers to vary an order granted by Justice Ndung’u.
