Ravi Shankar Prasad: Won't play role in picking of lower court judges: Centre


NEW DELHI: The central government will not get involved in appointment of judges for subordinate courts , law minister Ravi Shankar Prasad told a high-level advisory council meeting on national mission for justice delivery last week.Prasad requested the Law Commission to suggest a mechanism that would ensure timely recruitment of judges for the lower judiciary where there are more than 5,000 vacancies. At present, all recruitments to the lower judiciary is done by the state public service commissions, and in some cases by the respective high courts.This comes in the backdrop of a recent proposal floated by the law ministry for an all-India judicial services (AIJS) where the Centre, through the Union Public Service Commission (UPSC), could appoint district judges. However, a similar proposal in the past had been shot down by many high courts and states during the chief ministers and chief justices conference. The idea of AIJS was floated by the government for recruitment of district judges through a rigorous examination process to be held by the UPSC.However, many states objected to the proposal when it was first floated during the previous UPA regime as, they felt, it would adversely impact the promotional avenues of lower court judges. At present, subordinate court judges get promoted as district judges and then to the high courts.
