Police breath-testing inside people's homes, Dunedin lawyer says


Officers could not use this implied licence to enter homes in regards to driving matters or to carry out breath tests - the implied licence for breath testing ends at a person's front door. RNZ asked the police how many breath tests were carried out in people's homes in the last five years. The person will be advised they are required to accompany the officer for evidential breath test, blood test, or both. "Police is not aware of a deliberate practice of officers entering homes through implied licence to then breath test people who are unaware that officers don't have implied licence to enter homes. The police had no right to enter someone's home to carry out a breath test without express consent, she said.
