There was no way the petitioners challenging President Uhuru Kenyatta’s victory in the October 26 repeat election were going to have their way, not with the current political situation. On Monday, November 20, the judges of the Supreme Court by a unanimous vote, upheld the outcome of last month’s poll, only that their decision didn’t come as a surprise, not even to the petitioners. According to lawyer Waikwa Wanyoike who was holding brief for second petitioners Njonjo Mue and Khelef Khalifa, while submitting for his client, termed the timing of the petition as the elephant in the room. The real elephant in the room however was a country caught up in a prolonged political crisis whose solution could only be political and not one offered by Supreme Court. They didn’t have a choice but reject the call to intervene in what had morphed from being a legal problem to a political one.
