Omtatah moves to court, wants Mwilu barred from acting as Chief Justice


Human Rights Activist Okiya Omtatah says Deputy CJ Philomena Mwilu is not fit to act in the office the Chief Justice when David Maraga retires in January 2021. In a case filed in court, Omtatah wants the court to bar the Judicial Service Commission from appointing Mwilu to act in the office of the CJ unless they clear her of all the corruption allegations levelled against her. Omtatah says the case is extremely urgent because Maraga is set to go on his terminal leave from Tuesday next week and Mwilu is set to assume office in acting capacity pending the appointment of a new CJ. The activist further argues that there are currently four different petitions filed at the JSC seeking to remove Mwilu from office. Omtatah says he is aggrieved that the commission which is mandated to ensure the professionalism of judges is deliberately delaying to determine Mwilu’s matters.
