An ODM member has sued Migori Governor Okoth Obado for engaging in the party's affairs without giving notice of defection from PDP. Obado was elected on a PDP ticket during the 2013 general election but has openly declared that he will seek re-election through ODM. Through his lawyer Samuel Makori, Odede cited news reports on July 8, 2016 when Obado declared he would vie for re-election under Raila Odinga's party. He said the Orange Party violated the constitution and Political Parties Act, 2011 in failing to stop Obado from engaging in its affairs before a formal notice of his defection from PDP.
