This morning, OSHA issued a Trade Release announcing the issuance of a Final Rule that rescinds controversial provisions of the 2016 Rule to Improve Tracking of Workplace Injuries and Illnesses (2016 Rule), commonly referred to as the Electronic Recordkeeping Rule. The 2016 Rule required establishments with 250 or more employees to electronically submit information from the OSHA Form 300 – Log of Work-Related Injuries and Illnesses and Form 301 – Injury and Illness Incident Report. OSHA postponed the requirements amid legal challenges and a changing administration. The Final Rule will be published on January 25, 2019 and will be effective February 24, 2019. Covered establishments will still be required to electronically submit information from the Form 300A summaries as scheduled in the original rule.
