The Office of the Solicitor General (OSG) has asked the Supreme Court to reinstate thesyndicated estafa charges against Globe Asiatique (GA) owner Delfin Lee and four others accused of using ghost borrowers for P6.6-billion worth of Pag-IBIG Fund loans in 2009. Aside from Lee, named respondents to the case were his son and GA executive vice president, Dexter Lee; Christina Sagun, GA documentation department head; Alex Alvarez, Pag-ibig Fund lawyer and head of its foreclosure department; and Christina Salagan, GA accounting/finance department head. However, the OSG insisted that “all the elements of syndicated estafa are present.”“Delfin, Dexter, Sagun, Salagan, and Atty. The SC voted 7-5-2 to downgrade the syndicated estafa to simple estafa. The OSG maintained that Delfin and Dexter Lee did not file a motion for reconsideration before the lower court before they sought a CA reversal of the RTC ruling upholding their indictment and ordered their arrest.
