Now it’s the Eagles vs. Hotel California in a federal court

Look at all that hair #eagles A post shared by The Eagles (@theeaglesband) on Apr 15, 2016 at 9:33am PDTIn the popular song “Hotel California,” the Eagles’ Don Henley sang, “You can check out any time you like, but you can never leave.”That isn’t the case at Hotel California Todos Santos, an actual 11-room hotel in Todos Santos, Mexico, from which guests can both check out and leave. Even so, the Eagles contend the Baja California establishment has been using the name to suggest a connection with the band for financial gain. The band also contends that the hotel “actively encourage[s] consumers to believe that the hotel in Todos Santos is associated with the Eagles to further their sale” of these items by playing Eagles songs — particularly “Hotel California” — throughout its halls and in its lobby. The band had created two companies — Eagles Ltd. and Eagles Recording Co. — and claimed the foundation infringed on their names. Previously, the band sued a Dallas restaurant called Hotel California Grill for trademark violation.
