Criminalization of marital rape is a matter of constitutional and human right, the lawyer for RIT Foundation and the All India Democratic Women’s Association, said in a hearing on petitions filed by the two non-government organizations seeking to criminalize marital rape. A bench comprising acting chief justice Gita Mittal and justice C. Hari Shankar is hearing the petitions. “...sexual autonomy is a part of right to privacy as per the nine-judge bench judgement on privacy,” Nandy submitted.
