Morgan Stanley Uses Charging Order As An Entree To Appointment Of Receiver


Morgan Stanley Smith Barney LLC ("Morgan Stanley") won a $1.5 million arbitration award against Chris Johnson, which award was then confirmed in the U.S. District Court for the District of Minnesota. To enforce the judgment, Morgan Stanley asked the Court for a charging order against Johnson's interests in several LLCs, the appointment of a receiver for those LLCs, and an order foreclosing on Johnson's LLC interests. Morgan Stanley also complained that Johnson was not being forthcoming with responses to discovery about his assets. Morgan Stanley also asked that the receiver be given the power to investigate and marshal (collect) all of Johnson's other assets (other than the LLC interests). Whether Morgan Stanley really desires to foreclose is another question altogether, and one of those "be careful what you ask for" things.
