TORONTO — Dellen Millard and Mark Smich, who stand accused of murdering Laura Babcock, will not be testifying in their own defence, ending a mystery much debated among observers who have packed a Toronto courtroom and bringing this high-profile trial to its closing stages. There had been much speculation about how he might question himself on the stand, if he chose to testify. The jury has seen photos of Smich standing in front of the incinerator on the night prosecutors believe her body was cremated. The jury has been told to return on Dec. 5 for the first of the closing addresses. At the start of the trial, Code told jurors their duty was expected to be over before Christmas and on Wednesday he said he is content he has kept his word.
